No Cake Delivered, No Refund Given: Delhi Consumer Commission Orders IndiaCakes to Pay Compensation

The Delhi Consumer Commission has held online cake delivery platform IndiaCakes guilty of deficiency in service after it failed to deliver a birthday cake ordered for a woman’s grandmother and later refused to refund the money. The Commission directed the company to pay more than ₹5,000, including refund, compensation, and litigation costs.

The dispute began in February 2024 when two women ordered a pineapple cake and a bouquet through IndiaCakes for their grandmother’s birthday in Sultanpur, Uttar Pradesh. Although the website advertised free same-day delivery, the company demanded an additional ₹275 delivery charge shortly after receiving the order. Due to the importance of the occasion, the customers paid the extra amount.

Later that day, IndiaCakes informed them that the order had been processed for delivery. However, neither the cake nor the flowers were delivered. Initially, the company reportedly stated that the destination was too far and assured a refund. Two days later, it changed its stand and claimed that the recipient had refused to accept the order, refusing any refund.

After examining emails, payment records, and audio recordings submitted by the complainants, the Commission found that the delivery personnel had not completed the delivery because the location was distant. The evidence did not support the company’s claim that the recipient had rejected the order.

Holding that customers had paid the full amount but received neither the products nor a refund, the Commission ordered IndiaCakes to refund ₹1,031 with interest and pay ₹4,000 towards compensation and litigation expenses.
