National Symbols and Civic Responsibility: MP High Court Directs Reinstallation of National Emblem With Full Dignity

The Madhya Pradesh High Court has directed the Municipal Corporation, Betul, to reinstall the National Emblem at Itwari Bazar with “proper respect and dignity” after completion of ongoing construction work, while disposing of a public interest litigation challenging its temporary removal from the site.
The order was passed by a Division Bench comprising Justice Sanjeev Sachdeva and Justice Vinay Saraf in Raman Gothi v. State of Madhya Pradesh and Others. The petitioner alleged that the National Emblem installed at a prominent crossing in Betul district was being removed illegally by the Municipal Corporation, raising concerns over the treatment of an important national symbol.
During the hearing, counsel appearing for the Municipal Corporation clarified that construction activities were underway in the concerned area and the emblem was being removed only temporarily to facilitate the work. The Corporation assured the Court that the emblem was being handled carefully and would be restored at the same location once the project was completed.
Recording the undertaking, the Bench emphasized that national symbols must always be treated with utmost honour and respect. The Court directed the Municipal Corporation to ensure that the emblem is reinstalled with the dignity befitting its constitutional and symbolic significance.
Though brief, the order highlights the judiciary’s continuing emphasis on preserving the sanctity of national symbols while balancing practical administrative requirements such as public infrastructure development. The ruling also underlines that even temporary removal of such symbols must be undertaken with sensitivity, caution, and accountability toward constitutional values.
